Friend of the Court Handbook

This handbook provides useful information about the Friend of the Court and the child support enforcement program. The child support enforcement program was created under Title IV-D of the Social Security Act. In Michigan, the Office of Child Support (OCS) in cooperation with the Friend of the Court offices administers this program. The OCS is part of the Department of Human Services (formerly called the Family Independence Agency), and has the responsibility to administer Federal child support program funds, coordinate location of absent parents, and manage the process for income tax intercepts. The OCS may also initiate actions to have support orders entered under the Paternity Act of the Family Support Act, and to have support enforcement actions taken in another state.

Children love both parents and when parents do not live together, children and parents alike may experience anxiety which may cause anger, sadness and sorrow. Family structure and relationships will now become different, including the relationship between both parents and the children, because these changes involve different residences and a loss of family traditions. Separation of family is a very difficult time for all involved and can worsen when parents do or say negative comments to each other, children are the individuals most affected by the separation of family. Parents can help diminish children’s anguish by collaborating together to establish or maintain a child’s regular routine, encouraging frequent and regular contact between children and both parents and by being supportive of the other parent’s involvement regarding the children’s well-being.

While the husband-wife or significant other relationship may now end, the responsibility to be co-parents continues forever. Your children will always want both parents to be part of their lives, to attend high school or college functions, to be at their weddings, the birth of their children, and other major events throughout their lives. They want to be able to proudly say, that despite what my parents felt toward one another, they always treated each other with courtesy and respect and never placed us (the children) in the middle of their dispute.

Family law matters are difficult and painful, the Family Division of the Circuit Court has the responsibility to assist you to resolve the concerns which affect your family. The Family Division and the Friend of the Court are aware of the many emotions that complicate the legal decisions surrounding you and your children. Remember it is better to resolve your difference, before you require the assistance of a third party.

Please follow the suggestions in this handbook or any book dealing with the separation of family and you will be well on your way to doing your part to make your children’s lives happier and healthier.
