First and second offenses are misdemeanors and are handled in District Court. Third offenses are felonies and start in District Court, but may be bound over to Circuit Court. Defendants who are determined guilty of alcohol related offenses must undergo an alcohol assessment. This must be done prior to sentencing. Penalties may include fines and costs, incarceration, vehicle immobilization, driver responsibility fees, rehab programs, counseling, or any combination.
